Terms of Service - Online
(Revised March 10, 2009)
This Online Terms of Service statement is
applicable to all activities taking place on our website, including those
associated with any of our online services. We reserve the right to
govern all activities stated above by the terms set out in the following
statement, regardless of any claim refuting awareness of such terms. The conditions outlined in this statement
are also subject to change without prior notice.
Our Business With You:
The way we conduct business with you will be
determined by many factors:
(i) You have started an online service through the submission of a
form on our
website.
(a) In this situation, your service will begin
automatically after you have made
a payment, or
submitted a form to us through our website.
(b) The operation of the service you have
immediately begun, will be governed
by the terms you
agreed to upon starting that service.
(ii) You have made a custom order with a company representative, and
will not
pay or start into your service term, until all
work on our end has been
completed.
(a) After our obligation has been
fulfilled and your service term has begun, a
payment due
date will be established for a maximum period of one week
later than that date.
(b) Conditions of the bill payment process
are explained in the next section.
(c) Once all work has been completed for
the service you requested, full
payment may
be required up front before the service is provided.
(iii) You have made an upfront payment for a service we have agreed to
offer.
(a) We are obligated to fulfill the
original terms of your payment, or must offer
a full refund
if we have later seen reason not to fulfill our obligations.
Reasons For Service Cancellation:
The Promagnum Corporation reserves the
right to cancel any online service distributed to a client under any of the
circumstances stated below.
(i) The service is used to conduct in any form of criminal activity.
Our company
regularly monitors the use of its services, and will take the
necessary actions to
remedy any situation, including the discontinuation of its
services to a party, or
through an official report to legal authorities.
Unlawful use of our services is
considered to be the following:
(a) The distribution of
copyrighted material through sale or other trade methods,
without formal permission
of the author. Examples include the distribution
of copyrighted art,
music, or other digital entertainment goods.
Additionally, any service
or product provided to a client by our company
containing a single usage
license, may not be distributed to other parties.
Actions such as this are
strictly prohibited, and punishable under law.
(b) Promoting movements against individuals of a
particular race, gender,
religion, or sexual
orientation. Content that illustrates hatred in general, or
toward a particular
group, are most unwelcome on any of our services.
Your actions that display
these forms of behavior may be subject to legal
action.
(c) The display of adult content or other pornographic
material is not permitted,
including topics
associated with inhumane practices related to animals,
humans (child
pornography), or in general.
(d) Using our services to spam email addresses with
information that would
promote your website or
other priorities/interests. Spam means delivering
information to people who
never asked for it. You may think of it as junk
mail, which is strictly
prohibited.
(e) Trafficking illegal items such as drugs/narcotics,
weapons, or other items
that may have been
stolen.
(ii) The customer has not paid for the services they have received, although
we
provide the freedom of presenting a due date, at which
time payments for our
services are expected to be paid in full. The
following conditions apply to
situations where we have not received payment:
(a) Payments made to clear account balances will
be honored no later then
30 days after the
most recent payment due date.
(b) Our obligation to continue service after 30
days of not receiving payment,
will then be
considered as null. We maintain the right to add 1.5% interest
for up to 30 days after
the most recent payment due date, based on the
original charge total, to any outstanding
account balance. Your services
may stop immediately after 30 days, after which we no longer obligated to
recover or store your content, or continue any other service we have
granted use of.
Service Abuse:
The Promagnum Corporation reserves the
right to ban an individual's access to our online services, including any or
all of our websites. Conditions that make up our definition of service
abuse are mentioned below.
(i) Resources on our servers are used excessively by one IP address:
(a) IP addresses are relative to one customer
(location) who is served through
an internet service
provider. When our services are found to be spammed
through a specific IP
address or used excessively by it, we will promptly
place a ban on the
subject IP address. This is to prevent the excessive
leeching of online
services and/or resources that are funded through us.
Bans will deter any
future access to our websites and online services when
any individual attempts
to do so with the subject IP address. Some
situations may require
our Legal Division to file suit in the court of law, or
report prohibited
activity (Activity that violates the terms in particular of any
online service relative
to the situation, including those of using our website)
to legal authorities.
(b) The length of time IP addresses are banned will be
determined in
accordance to the
particular situation, and under our company's own
discretion. Bans
may be placed permanently on an IP address if the
situation is severe
enough.
(c) For uncompromised service performance and
security, we are not required
to alert the
subject party of an IP address, prior to, or after placing a ban.
(ii) The subject party is found guilty of criminal/unlawful activity or
offensive
behavior/content. Definitions of
criminal/unlawful activity or offensive
behavior/content were explained in the previous section
of this agreement.
Below demonstrates what will apply if we ban your IP
address for such cause:
(a) The length of time IP addresses are banned
will be determined in
accordance to the
particular situation, and under our company's own
discretion. Bans
may be placed permanently on an IP address if the
situation is severe
enough.
(b) For uncompromised service performance and
security, we are not required
to alert the
subject party of an IP address, prior to, or after placing a ban.
The terms established in this statement are subject to change without prior
notice, and are presented to supplement our
core
policies. It is the party's sole responsibility to acknowledge and
understand the above terms and conditions before using any of our online services,
or entering into a particular arrangement. We maintain the right to
justify what actions are acceptable in terms of what has been outlined in
this agreement, and what may require certain revision.
